1.1 General Terms & Conditions
Any deals between SIA NEW ROSME, 18 Hanzas Street, Riga, LV-1045, Reg. No. LV 40003138919 (hereinafter referred to as the “Seller”) and the Customer are governed only by these General Terms & Conditions (hereinafter referred to as “Terms & Conditions”) www.rosme.com.

2. General Terms of Use of Our Online Store.
2.1. When you create a profile in our online store, you transfer your personal data to us. We need your consent for processing your personal data, otherwise you will, unfortunately, not be able to use our online store. The type and form of processing your personal data are explained here: Privacy Policy.
2.2. Our goods are sold only in amounts intended for personal use.
3. Processing of Your Personal Data
3.1. Your consent to processing of your personal data is voluntary. However, we should indicate that if you disagree with this processing, then you will not be able to sign up and use our online store. All the other information about processing of data can be found in our Privacy Policy.
4. Orders.
4.1. Orders are made via the website www.rosme.com through registered user account or placing an order as a guest.
4.2. Items in our online store are labelled in such a way that you get information about their size, colour, price, and materials they are made of.
4.3. When you make an order, select the item you want, apply the necessary size, colour, quantity, and any other properties.
5. How to Make Purchases in Our Online Store?
5.1. Add the item selected from our product range to the online shopping cart by clicking “Add to shopping cart”.
5.2. All items added to the shopping cart can be viewed by clicking on the “Shopping cart” in the upper right section of the website. Here you can also delete items or change their quantity.
5.3. If you want to purchase the goods in the shopping cart, click “Checkout”.
5.4. You have to sign up to our online store to purchase any items. After you sign up, you will have access to other options such as order summary, stored delivery addresses, and order history.
5.5. Select the delivery method you like and the address.
5.6. Then you can specify your payment method. Your payment options: pay with your bank card, online banking, Apple Pay, Google Pay, Revolut or Paysera, by bank transfer when you receive your pre-payment invoice by email, as well as Post-paid (payment is made upon receipt of the goods at parcel lockers for orders up to 250 EUR).
5.7. By pressing “Confirm Order” the Customer agrees to buy the selected Item and undertakes to pay the specified price of the goods and delivery.
5.8. Having received your order, the Seller will e-mail you an order confirmation with details of your order.
5.9 The Seller may contact you by phone (if you specify your phone number) or by e-mail to clarify any matters that are unclear with regard to your order and delivery.
6. Prices.
6.1. All prices in the online store are indicated in euro, including value added tax as per legal requirements. Moreover, there are shipment costs, the amount of which depends on the delivery and payment options you have selected. Such costs are specified separately.
6.2. The price at the end of the order is the final price. The Seller and the buyer are bound by this price. It cannot change even if the Seller later reduces or increases the price of the goods.
6.3. Despite that the Seller reserves the right, within the scope of applicable legislation, to adjust prices in the online store, to offer new products, offer or discontinue discounts.
6.4. Within the promotion 2+1, the value of the item/s with the lowest price is calculated as a proportionally equal discount for each item in the basket.
7. Availability of Goods.
7.1. The goods offered in the online store are generally available. However, in some rare cases, when several customers order specific goods, it cannot be excluded that the goods may no longer be available. In this case, you will be notified immediately that the goods are not available. No agreement is concluded for the goods that are not available. Deliveries are made while items are available.
The sizes that are not available are highlighted in a different colour on the page than the sizes that are available.
8. Method of Delivery and Time of Delivery.
8.1. Any ordered goods are delivered only in the territory of Latvia, Lithuania and Estonia, as well as to other European countries.
8.2. We offer to deliver goods to one of the Rosme stores (only in the territory of Latvia), Omniva/DPD parcel lockers or with home delivery by DPD courier in the territory of Latvia, Lithuania and Estonia. To other European countries, delivery only by DPD courier to home.
8.3. We will contact you, if any of the items is no longer available or cannot be shipped due to other reasons.
9. Payment Methods.
9.1. Your payment options are: payment with your bank card, online banking, Apple Pay, Google Pay, Revolut or Paysera, by bank transfer when you receive your pre-payment invoice by email, as well as Post-paid (payment is made upon receipt of the goods at parcel lockers for orders up to 250 EUR).
10. Shipping Costs.
10.1. We ship to addresses in Latvia, Lithuania and Estonia, as well as to European countries listed in the Terms of Delivery section.

11. Right of Withdrawal.
11.1. You have the right to terminate the distance agreement within 30 days following the reception of the goods.
11.2. In order to exercise the right of withdrawal, the goods and the completed withdrawal form may be handed in at any Rosme store (only in the territory of Latvia) or sent to SIA NEW ROSME, Hanzas iela 18, Riga, LV-1045 no later than 30 days after receipt of the order. If the deadline falls on a public holiday, the right of withdrawal is exercised up to and including the working day following the deadline.
The withdrawal form should be sent together with the purchased item. You can find an electronic withdrawal form in section Returns & Exchanges, withdrawal form.
11.3. You can use the item only to the extent necessary to try it out. The returned item should look exactly as it looked originally, should have no damages or signs of wearing. The item should have all the original labels and protective films attached. When returning an item, the original packaging of the item should be packed in other shipment packaging.
11.4. Refund:
11.4.1 If the payment was made when completing the order:
We will refund the money for the returned product within 14 days from the moment you receive a notification that the order has been accepted for return (provided that the returned product corresponds to its original appearance). The payment will be returned to the bank account from which payment for the purchase was received.
11.4.2. If payment is made in parcel:
We will refund the money for the returned product within 21 days from the moment you receive notification that the order has been accepted for return (provided that the returned product corresponds to its original appearance). The payment will be returned to the bank account number you provide on the return form. .
12. Guarantee.
12.1. You can submit a complaint regarding defects in the purchased items in accordance with the Latvian Consumer Rights Protection Law. We will refund you any money paid for a defective item to your bank account.
12.2. The goods can be returned at any Rosme store (only in Latvia) or by returning the order using the return code sent by Omniva or the return label received by DPD. The item should be sent together with the withdrawal form. Any complaint will be examined within 30 days from receiving it. The Seller will inform the Customer of its decision. If the decision is positive, the Seller will refund the value of the item to the Customer by transfer to the Customer’s bank account. If the complaint is not considered justified, an opinion will be sent offering to receive the item back in the Rosme shop, Hanzas 18, Riga.
12.3. The delivery note for each order will be sent to the email address provided by the customer. The seller is not responsible for incorrect contact details entered by the customer.
13. Copyright.
13.1. The content of this website, including any photos, videos and texts are protected by the copyright law and other laws. These images, videos and texts are intended for private use only.
14. Changes to these Terms & Conditions.
14.1. These Terms & Conditions have been drawn up in accordance with regulatory enactments of the Republic of Latvia.
All the disagreements relating to these Terms & Conditions shall be solved through negotiations. If it is impossible to reach an agreement, any conflicts shall be solved in a court of the Republic of Latvia as prescribed by laws and regulations.
The Parties shall be released from the responsibility under these Terms & Conditions, if their performance is not possible due to force majeure.
14.2. The Seller reserves the right to amend and supplement these Terms & Conditions unilaterally at any time without a prior notice by publishing them on www.rosme.com, in section “Terms &Conditions”. The Buyer shall be bound by the Terms & Conditions, which are in force at the time of ordering goods and services. The Buyer must read the Terms & Conditions of www.rosme.com prior to making each purchase.
15. Responsibility.
15.1. The customer shall be liable for authenticity of the data provided in the signup form. If false information is provided in the signup form, the Seller shall not be responsible for it or its consequences, but is entitled to request from the Customer compensation of direct losses.
The Customer, who has signed up to the online store www.rosme.com, is fully responsible for all his/her actions.
The Customer shall be liable for security of his/her credentials. If Customer’s credentials are used by any third party, the Customer shall be responsible for that.
15.2. In all possible conflict situations, the Seller shall be free from any liability, if the Customer is inflicted losses, because, despite the Seller’s recommendation, the Customer has not read these Terms &Conditions, when he/she assumed the liabilities, although such an opportunity has been provided to him/her. Seller is not responsible for the Buyer's decision to purchase Goods on the basis of images.
In case of any losses the guilty party shall compensate direct losses to the other party.
